1. TERMS OF WEBSITE USE
1.1 This page (together with the Privacy Policy and Cookie Notice tells you the terms of use on which you may make use of our website under the domain www.nakas.gr (the "Site").

1.2 Your access to, and use of, the Site is subject to these Terms of Use and all applicable laws and regulations. Please read these Terms of Use carefully before you start to use the Site. By using our Site, you indicate that you accept these Terms of Use and that you agree to abide by them. If you do not agree to these Terms of Use, please refrain from using our Site.

1.3 The Site is a Site operated by Philippos Nakas S.A., a company incorporated in Greece with registered number 327701000 whose address is 19th Km of Lavriou Avenue, Paiania ("We").

1.4 All references to 'our', 'us', or 'we', in these Terms of Use are deemed to refer to Philippos Nakas

2. ACCESSING OUR SITE
2.1 Access to our Site is permitted on a temporary basis, and We reserve the right to withdraw or amend the service we provide on our Site without notice (see below). We will not be liable if for any reason our Site is unavailable at any time or for any period.

2.2 From time to time, we may restrict access to some parts of our Site, or our entire Site, to users. If the need arises we may suspend access to our Site, or discontinue it indefinitely.

2.3 If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these Terms of Use.

2.4 You are responsible for making all arrangements necessary for you to have access to our Site. You are also responsible for ensuring that all persons who access our Site through your internet connection are aware of these terms, and that they comply with them.

3. ACCESS RESTRICTION
3.1 We have the right to forbid and/or interrupt the transmission of the Site (or the operation of several of its services) to any user, as long as we according to our reasonable judgment believe that this access may jeopardize Us and/or the user and/or any third party, as well as that the user has violated the Terms of Use and/or the law.

3.2 We reserve the right to suspend the operation of the Site (or the operation of several of its services) because of update works, software improvement or improvement of its security functions. In that case, the Site will not be accessible by the users.

3.3 The customer who makes a purchase from a distance (on line) has the right to request withdrawal and return of the product purchased through our online store within 14 days from the date of delivery. The product must be delivered to the company within 14 days from the date of the withdrawal request. The product must be delivered in the same condition in which it was received by the customer, in its original condition, perfectly even, within its factory packaging, unused, unopened, and without damage to the product or its packaging, accompanied by all its accessories and packaging. The return, in order to be accepted, must be accompanied by the original purchase documents (retail receipt, invoice). A return in which the product has obvious signs of use or abuse is not accepted. For products that are returned in bad condition, with damaged packaging, opened, used, etc., whose value is deemed impaired, the company reserves the right to a corresponding impairment of the refund and always in accordance with the condition of the returned product. The customer is charged with the shipping cost of the return. In case that the product was sent to the customer without shipping charges, then he is also charged with the costs of the initial shipment to him. Product that was sold with an extra gift will have to be returned with the extra gift, otherwise the value of the gift will be deducted from the returned amount. The customer is responsible for any reduction in the value of the product resulting from handling that was not necessary to determine its nature, characteristics and function (Handling and testing of the product should be done in a way that would allow to the customer to perform them in a physical store of the company).

Product returns are not accepted when:

They concern on line orders which are received and paid in a physical store of the network of Philippos Nakas SA as these are not considered distance sales.
They concern devices that include software programs as well as any kind of material related to these programs in digital-electronic form, the use of which requires activation by the buyer or declaration of his personal data, actions by which the buyer becomes the only and exclusive user. The device means, for example, audio cards (audio interfaces), electric electronic music instruments, digital audio consoles and generally all machines used to create, play, edit and record audiovisual material.
They concern products that were ordered or manufactured according to the consumer's specifications (custom) or are clearly personalized.
They are for wind instruments, microphones and books
They concern products for which a special order was made on behalf of the customer after advance payment and do not belong to the planned stock of the company.

4. ONLINE ORDERS
4.1. The eNakas Music Store is connected online with the company's software ERP Atlantis, so that products can be updated with the company's actual stock.

4.2. Any order can be changed or cancelled, until the time of execution, either by telephone (210 6686000) or e-mail ([email protected]), quoting your order number and cancellation number. If your order has been already shipped, and you wish to cancel it, then you will be charged the transportation costs (delivery and return) and the product will be returned to the company. Returned products must be sealed and in perfect condition, as shipped. No returns are accepted for books and wind instruments. Additionally, no returns are accepted for products under "special order" status, which had been ordered to the manufacturer after an advance payment or complete prepayment.

4.3. The customer has the right to request the withdrawal of his order and return the product purchased through our online store within fourteen (14) days from the date of delivery. The product should be returned to the company within fourteen (14) days from the date of the withdrawal request, with the customer paying for the shipping costs. The product must be returned in perfect condition into its original packaging and all accessories. You can download the declaration of exemption file here. Excluded from the right of withdrawal are the following:

Devices with programs (software) and all kinds of material, associated with these programs, in digital - electronic form, for the use of which it is required activation by the purchaser or a statement of his personal data, actions by which the buyer becomes the sole and exclusive user of the program. Such devices are considered the sound cards (audio interfaces), electric - electronic musical instruments, mixing consoles and in general all the devices that are used to create, perform, edit and record audio - visual material.
Custom products ordered and manufactured according to the customer's specifications.
The wind instruments, the microphones, the headphones and the books cannot be returned.
Products under "special order" status, which had been ordered to the manufacturer only after an advance payment or complete prepayment.

4.4a If you wish to return your order and get a refund, the return must take place within 14 days from the day you collected your order and only under the condition that the products have not been used and they are sealed in their original packaging (sealed package). For a refund, the following terms apply:
If the payment is made by credit card, then the refund, after our command, is credited back to your card within 3-5 working days, depending on the bank issuing your card.
If the payment is made by cash in one of our stores, then the refund is made immediately as soon as the products have been returned.
If the payment is made on delivery, the refund takes place within 14 working days.
4.4b In case the product (s) of your order need to be returned to our company due to a manufacturer issue or an incorrect delivery from our company, the return of the product is free of charge with ACS courier at the address Philippos Nakas SA, 19th km Lavriou Avenue, Peania, 19002, Greece.

4.5 If the products ordered are available, the time required for the execution of your order is up to six working days. However, the delivery time varies according to the destination or even the method of shipment or collection. If your address is considered by ACS Courier as "out of reach", you will have to visit the closer ACS Store to collect your order since it will not be delivered to your address.

4.6 The "PHILIPPOS NAKAS SA" Company is not responsible for any errors in pricing, features and photos and reserves the right to change prices without prior notice. The transportation of goods in under the customer's responsibility.

4.7 According to REGULATION (EU) No 524/2013 and DIRECTIVE 2013/11/EU, which was transposed in Greece by Joint Ministerial Decision No 70330/2015, there is the possibility of online dispute resolution for consumer disputes with the process of Alternative Dispute Resolution across the European Union. If the customer is a consumer (i.e. a natural person acting outside his/her profession) and has any problem with a purchase made from our Website, he/she can initiate the ADR process through a single EU-wide online dispute resolution platform (ODR platform), available at https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.chooseLanguage. 4.8 The company can request for a deposit up to 50% or even a full deposit (depending on the product) for orders that are not readily available and are not part of the regular stock in our company.

4.9 Orders of readily available products are shipped within the timeframe mentioned above. Postponing shipments on readily available products can only be done, after the customer’s request and only if the product(s) have been paid.

5. INTELLECTUAL PROPERTY RIGHTS
5.1 The Site and all copyright and other intellectual property rights in all text, design, logos, graphics, icons, images and other materials on this Site (the "Content") are the property of Philippos Nakas S.A or are included with the permission of the relevant owner.

5.2 Your use of any Content, except as provided in these Terms of Use, without the written permission of the Content owner is strictly prohibited. We will enforce our intellectual property rights to the fullest extent permitted by the law, including the seeking of criminal prosecution.

5.3 You are hereby permitted to use the Site as follows:
